Judge’s actions are a threat to the men and women of the NYPD
Assemblywoman Nicole Malliotakis, the presumptive Republican nominee in the race for mayor, today called for Brooklyn acting Supreme Court Judge Loren Baily-Schiffman to be demoted back to Civil Court. Malliotakis called the judge and her actions, “a threat to the men and women of the NYPD and to the citizens of our city.”
Malliotakis was referring to a case this past weekend where Judge Baily-Schiffman released a mentally ill man without bail or a psychiatric evaluation after he had attempted to he attempted to grab the gun of a police officer during a scuffle at the 83rd Precinct in Brooklyn. The suspect was charged with numerous counts, including assault on a police officer, attempted criminal possession of a weapon and attempted robbery. Prosecutors asked Judge Baily-Schiffman to hold the suspect in lieu of a $250,000 bail, but, the judge ordered him released on his own recognizance.
Assemblywoman Nicole Malliotakis said, “Less than a week before this incident took place, New Yorkers witnessed the cold-blooded assassination of NYPD Officer Miosotis Familia in the Bronx by a mentally ill suspect. Any suspect who attempts to grab a police officer’s gun and threatens to kill themselves or another deserves to be behind bars, or at the very least, should be placed under observation on a 72 hour-psychiatric hold. The fact that this suspect was released is a threat to the men and women of the NYPD and to the citizens of our city.
“This wasn’t the only questionable decision by Judge Baily-Schiffman this past weekend. On Sunday, she also disregarded prosecutor’s request for bail when she placed a suspect, who had threatened to kill a nun in a Brooklyn Church, into Mayor de Blasio’s Supervised Release Program. On the same day, she also released 2 thugs on their own recognizance after they were charged with hate crimes for assaulting, punching and threatening to lynch an African American male on the streets of Sheepshead Bay. In that case prosecutors had requested a $50,000 bail for each suspect.
“When a judge releases suspects like these; all New Yorkers are placed at risk. Today, I call on Chief Administrative Judge Lawrence K. Marks to remove Judge Loren Baily-Schiffman from criminal court and demote her to the civil court position she was elected to. I also call on Mayor Bill de Blasio to show leadership and do the same. One would think that after attending the funeral of a police officer who was gunned down in cold blood, Mayor de Blasio would speak-out to insure that this judge never takes actions like these again.”
